- Complex Editing
- Formatting
- Light graphic design
Any additional creative services will be considered on a case-by-case basis and must be agreed upon in writing by both parties.
3. Payment Terms
- Deposit: A 20% deposit is required upfront to secure your booking (unless otherwise agreed in writing).
- Payment due: Remaining balance is due within 7 calendar days of the invoice date.
- Late payments: A late fee of 5% of the invoice total will apply if payment is more than 14 days overdue.
- Accepted payment methods: Payment can be made via PayID or bank transfer (processed through Hnry).
Rates, pricing structures (per hour, per word or project-based), and deliverables will be discussed and confirmed before work begins.
4. Turnaround
Turnaround times will be estimated and agreed upon prior to starting. These may vary depending on project size, scope, and availability.
If the client is late delivering materials or feedback, deadlines may need to be adjusted accordingly.
5. Cancellations & Refunds
If the Client Cancels:
- If the client cancels after work has commenced, a partial payment may apply based on the portion of work completed (e.g. if the project is nearly finished, the partial charge will be higher).
- Any work completed may be provided once payment for that portion has been received.
If the Client is Unsatisfied with Work:
If payment has already been made, the client may choose one of the following:
- Request a revision based on the original brief and agreed expectations, at no additional charge.
- Request a partial refund. A refund of up to 50% may be considered, depending on the concerns raised and the amount of work completed.
If payment has not yet been made, the client may choose one of the following:
- Request a revision based on the original brief and agreed expectations, at no additional charge.
- Request to end the project. In this case, a partial payment of up to 75% may still be charged for time and labour already invested.
If In Other Words Creative Cancels the Project:
- Any work completed will be delivered free of charge, unless a substantial portion of the project has been completed—in that case, a partial payment may be discussed.
- A discount may be offered for a future project as compensation.
6. Client Responsibilities
- Clients must provide the material to be worked on in a mutually agreed-upon format, along with any relevant style guides, sheets, or reference documents. A final deadline will be agreed upon before work begins.
- If design elements are included in the service, the client will be asked to confirm the scope, preferences, and any relevant visual direction at the start of the project.
Both parties will agree on the preferred communication method (e.g. email, messages, video call) and suitable response hours before starting.
7. Confidentiality & Copyright
- All work remains strictly confidential unless both parties agree otherwise in writing.
- Clients retain full copyright to their original work. Where In Other Words Creative has significantly rewritten or co-authored content, credit or shared copyright may be negotiated and agreed upon in writing.
- Once full payment is received, all rights to the final edited or rewritten content transfer to the client.
- Ownership of design work transfers to the client once full payment has been received.
Important: Use of edited or rewritten content or design work without full payment constitutes a breach of copyright and may have legal or academic consequences.
8. Rights & Refusals
In Other Words Creative reserves the right to decline any project, for any reason, at any time. This may include (but isn’t limited to) issues of scope, content, tone, or availability.
Finished work will only be used in promotional materials or the In Other Words Creative portfolio with the client’s explicit written permission.
9. Liability
In Other Words Creative strives to ensure accuracy, clarity, and quality in all services provided. However, no liability is accepted for any losses, including financial, reputational, or consequential damages, arising from errors, omissions, or other issues that remain in the final work after delivery.
In Other Words Creative does not provide legal, financial, or publishing advice and assumes no responsibility for decisions made based on the content delivered.
It is the client’s responsibility to thoroughly review and approve all content prior to publication, submission, or distribution. Clients are encouraged to seek professional advice where necessary before publishing or relying on edited material.
10. Legal
These Terms and Conditions are governed by the laws of Western Australia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
11. Privacy
Any personal information collected (such as names, email addresses, or payment details) will be kept strictly confidential and used solely for the purpose of providing services. The client’s information will never be sold or shared without their consent.
